1. Introduction
This website is operated by SolutionOne Pty Ltd: ABN 58122335924 trading as BYOD Store (“we”, “us”, “our”).
These Terms of Service ("Terms") govern your use of our website www.byodstore.com.au and the purchase of electronic and computer hardware, peripherals, educational products and other products ("Goods") from us.
2. Application of Terms
2.1. These Terms apply to all sales of Goods by us to any buyer ("Customer", "you").
2.2. These Terms prevail over any written terms and conditions of the Customer (such as those found on a Purchase Order), unless explicitly agreed to in writing by us.
2.3. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
3. Orders
3.1. Order Acceptance: Your order is an offer to buy. A contract is only formed when we send you confirmation of successful payment.
3.2. Cancellation: You may not cancel an order once the Goods have been dispatched without our written consent. Cancellations may be subject to a restocking fee where permitted by law. See our Returns & Refund Policy for more information.
3.3. Right to Reject: We reserve the right to reject an order for any reason, including unavailability of stock, error in the price or description, payment discrepancy, or suspected fraudulent activity.
4. Products, Pricing and Payment
4.1. Products: We make every effort to ensure product descriptions, specifications, and images are accurate. However, we do not warrant that product descriptions or other content is error-free, complete, or current.
4.2. Availability: Product availability is subject to change. If a product becomes unavailable after you place an order, we will notify you and offer a refund or alternative product.
4.3. Pricing: We do our best to provide competitive pricing. Because of the dynamic nature of this industry (e.g. vendor price changes and other variables beyond our control), prices, promotions, versions and availability advertised are subject to change without prior notice. We do not offer price matching or added discounts above any discounts noted on the products page.
4.4. Currency & GST: All prices are in Australian Dollars (AUD) and, unless otherwise stated, include Goods and Services Tax (GST).
4.5. Payment Terms: Payment is due immediately at checkout and can be made by Visa or Mastercard.
4.6. Payment Processing: We use secure payment processing systems. We do not store complete credit card details on our servers.
5. Delivery, Title, and Risk
5.1. Locations: We deliver throughout Australia. We cannot deliver outside of Australia.
5.2. Delivery Estimates: Delivery times are estimates only. We are not liable for delays caused by third-party couriers or events beyond our reasonable control.
5.3. Risk: Risk of loss or damage to the Goods passes to you upon delivery to your nominated address.
5.4. Retention of Title: Ownership (Title) of the Goods does not pass to you until we have received full payment.
5.5. Shipping Rates: BYOD Store has a flat shipping rate of $19.95 per order.
5.6. Delivery: We primarily use StarTrack for all deliveries. All deliveries require signatures.
6. Australian Consumer Law (ACL) & Warranties
6.1. Consumer Guarantees: Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
6.2. Manufacturer Warranty: In addition to your rights under the ACL, some Goods may come with a manufacturer’s warranty. This warranty is provided by the manufacturer, not by BYOD Store, but we will reasonably assist you in making a claim.
6.3. Warranty Against Defects: If we offer a specific express warranty against defects for a set period, the benefits of this warranty are in addition to your rights under the ACL.
6.4. Extended Warranty: We may offer additional warranty options for purchase at the checkout. Terms and conditions of extended warranties are provided separately.

7. Returns and Refunds
We are not required by law to provide a refund if you simply change your mind, ordered the wrong equipment, or found it cheaper elsewhere.

8. Liability
8.1. Maximum Liability: To the maximum extent permitted by law, BYOD Store is not liable for:
- Indirect, special, or consequential loss such as loss of data, loss of profits, or business interruption.
- Damage resulting from misuse, unauthorised modification, or improper installation of the Goods.
8.2. Total Liability: Our total liability to you in connection with these Terms shall not exceed the total amount paid by you for the Goods giving rise to the claim.
9. Privacy
We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

10. Dispute Resolution
10.1. Good Faith Resolution: We are committed to resolving disputes fairly and quickly. Please contact us first if you have a complaint.
10.2. Alternative Resolution: If we cannot resolve a dispute directly, you may contact Consumer Affairs Victoria or seek assistance from relevant industry ombudsman schemes.
10.3. Jurisdiction: These Terms are governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any disputes.
11. Intellectual Property
11.1. All content on our website, including text, graphics, logos, images, and software, is our property or our licensors' property and is protected by intellectual property laws.
11.2. You may not reproduce, distribute, modify, or create derivative works from our website content without our prior written consent.
11.3. Product names, logos, and trademarks belong to their respective manufacturers.
11.4. You are responsible for ensuring all software and products comply with applicable licensing agreements and educational use requirements.
12. General Terms
12.1 Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us.
12.2 Amendments: We may update these Terms from time to time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use constitutes acceptance of updated Terms.
12.3 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
12.4 Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
12.5 Assignment: You may not assign or transfer your rights or obligations under these Terms. We may assign our rights without restriction.
12.6 Force Majeure: We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control.
